Court Upholds Decision To Bring Air Astana To Liability

A Specialized Interdistrict Administrative Court of Astana, Kazakhstan, dismissed the claim of Air Astana JSC on the abolition of the decision of the Committee for Natural Monopolies Regulation and Protection of Competition under the Ministry of National Economy, Kazakhstan, to attract this air carrier to administrative liability for failure to provide information which was requested prior to the start of the investigation.

According to the Ministry of National Economy of Kazakhstan, the decision was made on October 11, 2016. One reported that one has initiated investigation with respect to the Air Company based upon complaints provided, as regards fixing monopolistically high prices for air transport services. Also, the antimonopoly authority initiated administrative proceedings against Air Astana JSC for obstructing officials in the investigation.

In addition, the Office commented on the statements made by Air Astana representatives, widespread in the media earlier. “According to the investigation object, the antimonopoly authority employees were admitted on September 20th and October 3, 2016. Meanwhile, the administrative case against the airline was instituted for the absence of permission to allow employees on October 7, 2016. One should note that according to the legislation, the investigation object is obliged to grant access to the premises and perform other legal requirements of the persons from the antimonopoly agency for the duration of the investigation, which is two months”, the agency reported.

Previously, Air Astana explained the increase in air ticket prices. Also, representatives of Air Astana said that they have appealed to the prosecutor’s office with a complaint on the antimonopoly agency.
