In accordance with the adoption procedure in the Republic of Kazakhstan, foreigners, wishing to adopt a child-citizen of the Republic of Kazakhstan, should apply to authorized bodies of the Republic of Kazakhstan (Children Welfare Agencies) through diplomatic and consular offices of the Republic of Kazakhstan and submit the following documents:
· Written adoption petition
· Financial status certificate
· Marital status certificate
· Health certificate
Report about personal moral qualities of the potential parents, issued by Children Welfare Agencies or by agencies, which provide such services in accordance with state license.
During consideration of the petition, other necessary documents could be requested.
Thus, if candidates for adoption have different citizenships, they should obtain an additional permission for the adoption from authorized agencies of both countries, as well as permission for entrance and residence of a child in countries of citizenship of the spouses. This permission for the adoption and possible entrance and residence of a child-citizen of the Republic of Kazakhstan can be drawn up in a form of a guarantee letter from the authorized agency which is responsible for adoption affairs.
All listed documents should be translated into the Kazakh and Russian languages, legalized and apostillized.
In accordance with the rules of registration for foreign citizens, who wish to adopt children-citizens of the Republic of Kazakhstan, foreign citizens must be registered in consular offices of the Republic of Kazakhstan in given countries.
Document should be submitted to the Children Welfare Agency. After receiving of a response about possibility of adoption from the Children Welfare Agency, a diplomatic or consular office of the Republic of Kazakhstan, if there are any visa restrictions, issues a special visa to a foreigner to enter the country.
This visa can be issued only based on the invitation letter, issued by the Ministry of Education and Science of the Republic of Kazakhstan and its oblast departments. It is forbidden to use other visas’ categories (for example a tourist visa) for the entry into the Republic of Kazakhstan on the purpose of adoption.
After the entry into the Republic of Kazakhstan, foreigners must personally choose a child and have personal contact with the child at least for two weeks (personal acquaintance to a child and his/her habits).
The adoption shall be executed by the court on a petition of persons (a person), who wish to adopt a child. The consideration of adoption cases is performed by the court in form of special legal proceedings according to the rules, stipulated by Code of Practice of the Republic of Kazakhstan.
After making a final decision, the Children Welfare Agency and Migration Police of Kazakhstan issue a certificate of adoption, a birth certificate and a national passport of the Republic of Kazakhstan to the adopted child.
Note: In accordance with the legislation of the Republic of Kazakhstan, an adopted child remains a citizen of the Republic of Kazakhstan unless he is 18 years old. The renunciation of citizenship of the Republic of Kazakhstan is permitted after attainment of majority by a child and on his/her wish. Thus, the entrance and exit of the child into/out of the Republic of Kazakhstan should be done with a Kazakhstan passport.
After arrival to a country of residence, a child should be registered in the nearest representation of the Republic of Kazakhstan. This procedure is necessary to be aware where a child – citizen of the Republic of Kazakhstan – is residing, in the case of necessity to provide all possible assistance to a child, for example, to restore a lost document, prolong of the passport validity or issue a new document.
Adopting a child from the Republic of Kazakhstan, foreigners take responsibility for his/her future. At this, knowing that an adopted child is a citizen of the Republic of Kazakhstan, foreigners should respect both the legislation of their country and the legislation of the Republic of Kazakhstan and meet all provisions stipulated by this legislation.
